Whataburger is set to open a new location in the former Midtown police station, situated at 1925 Union Ave. This comes as part of a modified special use permit request submitted to the Memphis and Shelby County Division of Planning and Development.

The Texas-based fast-casual burger joint already operates six restaurants in the Greater Memphis area, including spots in Memphis, Millington, Arlington, and Cordova.
The recent permit application seeks to amend a previously granted special use permit to accommodate a drive-thru adjacent to the proposed 3,318-square-foot Whataburger location. Approval for the drive-thru will be needed from both the Land Use Control Board and the Memphis City Council.
According to the permit application, the new Whataburger restaurant will feature a drive-thru, an outdoor patio, and a parking lot, all of which will be situated on a 1.06-acre parcel of land owned by EP3 Developers LLC. This site is part of a larger 3.62-acre property that EP3 Developers purchased for $3.5 million in April 2022.
EP3 Developers has plans to transform the surrounding area into a mixed-use space, an ambitious project that received approval last August. This development will feature a hotel and ten townhouses, with Whataburger currently listed as the sole tenant in the commercial space.
